Wytheville woman pleads guilty to sexually abusing boy

A Wytheville woman admitted on Wednesday that she sexually abused a boy when she was 18 and the child was 5.

Now 19, Brooke Nichole Smelser pleaded guilty to taking indecent liberties with a child during a brief hearing in Wythe County Circuit Court.

She had originally been charged with two counts of aggravated sexual battery, but one of those charges was dropped on Wednesday and the other one was amended to indecent liberties, a felony.

In summarizing the evidence against Smelser, Assistant Commonwealth’s Attorney William Winters said that she exposed her breasts to the boy and kissed and fondled him sometime between 2011 and 2012. The child told a relative about the abuse, which led to the criminal charge.

Smelser was indicted in July 2012.

On Wednesday, she quietly answered “yes, sir” and “no, sir” to the judge’s questions after she entered her plea.

In addition to losing her right to vote and possess a firearm, Smelser has to register as a sex offender.

Her sentencing was postponed until Sept. 12 so that Smelser, who remains free on bond, can undergo a psychological evaluation and so that the probation office can put together a pre-sentence report about her criminal history, if any, and personal background.

She could face up to 10 years in prison and a fine.
